A Brief History of KSR
When Kerala was formed in 1956, the following Rules existed which were applicable for the State Govt servants serving at that time viz,
(1) The Travancore Service
Regulations,
(2) The Cochin Service Regulations and
(3) The Fundamental
Rules (Madras), the Madras Pension Code and the Madras Manual of
special Pay and Allowances.
The need for a unified code was obvious.
It is stated in the Constitution of India that every state government shall form appropriate rules to govern service conditions of their respective services (PART XIV, CHAPTER 01 , ART. 309). Accordingly the Kerala LA passed the 19th Act of 1968 viz, Kerala Public Service Act 1968 , based on which KSR was validated which came into being in 10.11.1959
Applicability of KSR as a whole -Rule 2
Only to those in the whole time employment of the Government. Thus in general other categories are not bound by KSR
But before the Kerala Public Service Act 1968 (Act 19 of 1968 )was passed, KSR came into being on two different dates
PART ONE and TWO joined PART THREE on 1959 November 01
PART THREE had come into force on 01/11/1956, the date on which The State of Kerala was formed on linguistic ground.
PART ONE -
1) Leave
2) Joining Time
3) Pay
4) Pay Fixation
6) Dismissal
7) Removal
8) Suspension
9) Combination of appointment etc
PART TWO
Travelling Allowance
PART THREE
Pension
Service Book/Service Records etc
APPLICABILITY OF PART ONE AND THREE
1. Full (Whole) time , appointed on or after Nov 1 1956 Excluding contingency and work establishment staff
2. In service persons of erstwhile Thiru-Cochin/ Madrass States who accepted KSR in writing.
3. The State Govt has declared as applicable (eg, aided school staff)
NON APPLICABILITY OF PART ONE AND THREE
1. Contingency
2. Work Establishment
3. Other service conditions viz, IAS, IPS, Judges of HC etc
4. Appointments to Personal Staff of Ministers. (Only special rules excepted. Other rules applicable)
APPLICABILITY OF PART TWO (TA)
1. Every full time employee except work establishment and contingency staff
2. Temporary staff (appointed as per Rule 9 of General Rules) , only those specifically stated if any.
