Probationer

P R O B A T I O N E R . . . . . . is   a new appointment in a permanent vacancy whose service is subject to confirmation . 👉 Job training and efficiency evaluation are the main objectives of Probation. FOR CLERKS In Revenue Department : 2 Years continuous duty in continuous 3 years and a Pass in DOM (District Office Manual) In Other Departments : 2 Years continuous duty in continuous 3 years and a Pass in MOP In Secretariat category : 2 Years continuous duty in continuous 3 years and a Pass in Secretariat Manual.

Presumptive Pay

 Presumptive Pay Salary due to an officer in normal due course. This is relevant when HPL is allowed, (LEAVE SALARY) Example: An officer drawing a salary in the scale 12250-19800 @ 13610 w.e.f 1.1.2019 and goes on HPL on 2-2-2019 to 16-2-2019. His HPL is for 15 days. His Presumptive salary is 6805(for 15 days) and his Leave salary will be based on 6805  for the HPL period.

Dearness Pay

 Dearness Pay (Not to be confused with DA) DA is converted as DP  Ex. An officer received 64% DA in April The Government decided that 50%  DA be converted as DP Here, The officer gets 150% Pay and 14% DA. The 50% so merged is termed as DP. In all Salary Certificates and Documents relating to Salary , the Dearness Pay should be specifically mentioned.

PAY

 PAY Pay EXCLUSIVE of Special Pay , Dearness Pay, Personal Pay is generally regarded as PAY. 👉EXCEPT  For Pay Fixation, DP+ PP+ SP is taken into account as Pay. 👉 Other cases , BP+DP+SP etc are added to count the Pay. According to GO(P)7/2016 dated 20.1.2016 , Pay is the stage at which his salary is fixed. If the maximum stage is not sufficient for fixation, Personal Pay is mooted.

Dies-Non

 Dies-Non (14 A Participating in a strike and not presenting oneself for the duty , is always considered no work no pay. NOT The incumbent is not eligible for pay and allowances for this day. Not  a qualifying time for EL. Not qualified for Probation. BUT But qualifies for increment and HPL.

Late Attendance

Rule 14  Note 1.-Every officer must attend the office punctually. For every three day’s late attendance without permission, an officer will forfeit a day’s casual leave for which he is eligible. The computation of the forfeiture of a day’s casual leave will be with respect to the calendar year and late attendance without permission for less than three days at the end of a calendar year will be ignored.  Note 2. - No other kind of leave except casual leave shall be forfeited for late attendance without permission. Disciplinary action under the Kerala Civil Services (C.C and A.) Rules, 1960 may be taken against the officers concerned for late attendance without permission if there is no CL

Officiating

 Officiating a) Employed in a post in the place of an officer in his absence b) In an open vacancy/vacant position,  Example : A , a selection grade headmaster goes on leave for 3 years, and B a senior High school assistant is promoted to his position. A has a lien in his post and B is said to be officiating. If A retires on March 31 , the vacancy is said to be open and a Selection Grade Assistant is promoted to the post, the latter being officiated.

Month

MONTH  The period from a specific date to the previous day of the same date in the next month is called a month Example : January 02 to February 01 January 31 to February 28/29 Example:01 Calculate the date of 1 year, 5 months and 18 days from 24-05-2016 ? First Year is counted -      23-05-2017 Secondly Month is counted - ( 5 Months) 23-10-2017 Thirdly 18 days                         -  10-11-2017  Example 02 25-10-2014 - 18-04-2019  is a leave period . Find the duration of the leave. 1. 24.10.2018                   4 year 2. 24.03.2019                       5 months 3.  25 days Answer is 4 years, 5 months and 25 days                      

Local Fund

 The Fund , utilization right of which rests with the body that raises the fund is called a Local Fund Example : University Fund/ municipal fund/ Panchayat Fund etc

Lien

 Lien  Is a right of the officer in his lower post (substantive) when he is promoted or otherwise to a new post.

Joining Time

 Joining Time Joining time constitutes Journey Time plus Preparation Time (if applicable, preparation time is not an everyday affair, and allowed in certain conditions only)in the case of a Transfer.

Foreign Service

 Accepting pay and allowances from a fund other than Government Fund and discharging duties in an entity whose fund is not treated as Govt Fund is called with due Government permission is called a Foreign Service. Not to be confused as serving a foreign country. This is possible only when prior Government sanction is obtained by the officer. Ex. If a DySP in the Kerala Police Department chooses to accept the post of Chief Security Officer of Titanium Products, Tvm , his salaries and allowances are met from the said corporate fund and not from the Consolidated Government Fund. In this case he is said to be in Foreign Service

HONORARIUM

 Is paid out of CONSOLIDATED/GEN/ PUBLIC Fund for special duties which normally do not form part of their routine duty Ex. Departmental Exam valuation, Election Duty, Census Duty etc.

FEE

 Fee is the sum distributed out of any fund other than CONSOLIDATED FUND / PUBLIC FUND/GENERAL FUND Consolidated fund means Vehicle Tax, Land Tax etc.  The exchequer receives other funds such as University Fund etc. which is not a typical Govt fund. Govt is only a custodian of such a Fund. If a University professor receives paper valuation fee out of University Fund, it is an example of FEE.

Day

A day is counted as  12.00 am to 12.00 pm  FOR CALCULATION OF DAILY ALLOWANCE If his absence is less than 24 hrs, without considering the time of beginning of absence and end of absence, it is counted as JUST ONE DAY But if an officer stays away from his quarters for less than 24 hrs, its just calculated as one day. An officer traveled from Kottayam to Thiruvananthapuram on 7 th July afternoon and reached his destination at 5.00 pm on the same day. He stayed in Tvm up to 8th July 1.00 pm . His stay : 5.00 pm to 12.00 am (July 7)= 7.00 hours  12.00 am to 1.00 pm (July 8) = 13.00 hours  In normal cases , if stay is more than 6 hours but less than 12 hours he is eligible for 1/2 Daily Allowance and for more than 12 hours but less than 24 hours for one Daily Allowance. But in this case, he is eligible for one DA only as his stay is less than 24 hours.( 20 hrs in this case )

Special Pay

Case 1. Additional responsibility of a higher post  Case 2. Additional responsibility of any other nature  Special Pay is now allowable only in the above case 1. All other cases, Special Allowance is allowed with specific rates in the Pay Revision order of 2016 (Case 2) Special Allowance ranges between 60/- and 4000/- pm

Personal Pay

 Additional pay to compensate a fall in Basic Pay not due to any disciplinary action. This is allowed only up to the stage where the difference is fully compensated. Example.  An officer was drawing a 57440/- as BP in 40640-57440 scale. The post is abolished and he is absorbed into another post with a scale 36140-49740. As per Rules his new pay is ordinarily fixed at 49740/- which is the maximum in the new scale. But he was drawing 57440/- which is not in his current scale of pay. His last salary of 57440/- needs to be protected , salary will not decrease in any normal event except in case of disciplinary demotion etc.  Hence 7700/- is allowed as Personal Pay to compensate this loss. This Personal Pay portion decreases with the rise in the pay.

Compensatory Allowance

 Eg: TA, DA, HRA etc are examples

CADRE

Belonging to a segment of class or division based on certain criteria . Example : Executive, ministerial , non-gazetted executive , non gazetted ministerial cadre etc

APPRENTICE

  An apprentice is a trainee on consolidated pay usually called stipend  as decided by the govt from time to time.

A Brief History of KSR W hen Kerala was formed in 1956, the following Rules existed which were applicable for the State Govt servants serving at that time viz,  (1) The Travancore Service Regulations,  (2) The Cochin Service Regulations and  (3) The Fundamental Rules (Madras), the Madras Pension Code and the Madras Manual of special Pay and Allowances.  The need for a unified code was obvious. It is stated in the Constitution of India that every state government shall form appropriate rules to govern service conditions of their respective services (PART XIV, CHAPTER 01 , ART. 309). Accordingly the Kerala LA passed the 19th Act of 1968 viz, Kerala Public Service Act 1968 , based on which KSR was validated which came into being in 10.11.1959 Applicability of KSR as a whole -Rule 2 Only to those in the whole time employment of the Government. FIXATION AS PER RULE 28

  1.Pay is fixed as per Rule 28 only if the officer gets promoted from a substantive post to another substantive position in which case he loses his lien in the lower post and as such any increment in the lower scale shall no be considered at all for the HTS (Higher Time Scale) 2. PAY FIXATION-KERALA SERVICE RULES Article  by S u d h e e s h  V a i k o m   When we discuss Pay Fixation, we have THREE RULES to consider [1) Rule 28 , 2) Rule 37 (a) , and 3) Rule 28 ] 1. RULE 28      WHEN  - New Scale (Higher Time Scale ) begins with a Pay greater than Rs.68,700/ -and the when a  substantive officer is promoted to a substantive post. Note : Time scale or Pay scale contains Basic pay and increments only.
